GPS Tracking - What are Private Investigators legally allowed to do in Virginia?

Even though using a GPS tracker seems like an easy place to start a surveillance investigation, it is important to realize that the case must fall within the very specific legal parameters of Virginia and is never a complete substitute for conventional surveillance measures from experienced investigators.



INFIDELITY CASES

VA Code 18.2-60.5 states that a private investigator can only use a GPS tracker "with the consent of the owner of the property upon which the electronic tracking device is installed and placed. However, such exemption shall not apply if the private investigator is working on behalf of a client who is subject to a protective order."


This means we can only place GPS trackers on personal or marital property, so proof of ownership will be required before proceeding.
